The agreement between the Customer and MJ Granite is subject to product availability. No other terms apply unless agreed in writing or orally and confirmed by a replacement Sales Order delivered to the Customer by hand or email.
Unless stated otherwise, all prices are exclusive of sales and use taxes (if applicable) and exclusive of freight and delivery fees. The Sales Order outlines the price, payment terms, and deposit amounts. Payment in full is required before scheduling delivery. Special and Custom Orders require 100% payment to place an order.
Customers must confirm that the Sales Order contains accurate information regarding products, pricing, quantities, payments, and delivery details. MJ Granite’s assistance relies on the information provided by the Customer, and MJ Granite is not liable for mistakes due to inaccurate information. It is the Customer’s responsibility to verify quantities, dimensions, and site conditions with the installer.
MJ Granite provides an estimated arrival date for the product. Once the product is ready, the Customer will be informed of available delivery dates. MJ Granite strives to meet estimated dates, but actual delivery may be delayed due to circumstances beyond its control. Delivery re-scheduling and order status inquiries can be addressed with MJ Granite. Customers must provide a valid and accurate shipping address. Missed delivery attempts may incur extra fees, and deliveries are made curbside, to driveways, or garages.
Upon delivery, the Customer must ensure all items are satisfactory before installation. Any damaged, incorrect, or missing items should be reported immediately. Failure to do so may result in losses for which MJ Granite is not responsible.
Once MJ Granite delivers the products, responsibility for them, including the risk of loss or damage, transfers to the Customer.
Some products, particularly natural stones like marble, may have shading, size, or pattern variations. These are inherent to natural materials and are not considered defects. Customers should expect variations from catalog images. Samples may be requested to show material ranges.
All products must be installed according to approved industry standards. Installation constitutes product acceptance. MJ Granite does not provide installation services unless agreed upon in a separate contract.
MJ Granite retains legal ownership of the product until payment in full is received. If the Customer takes possession before payment, they must hold the product on behalf of MJ Granite.
Special Orders, Final Sale items, and Custom Orders cannot be canceled after 24 hours from the Sales Order date. Other orders can be canceled within 15 days, provided at least 72 hours’ notice is given before delivery.
Returns or exchanges are only accepted with prior authorization and are not allowed after 30 days from delivery. Only full orders can be returned, and a restocking fee (20%-50%) plus shipping costs may apply. Special Orders and Custom Orders cannot be returned or exchanged.
Refunds for purchases over $25 made by cash or check will be issued via check within 10 business days. Credit card refunds will be credited to the card used for the original purchase.
All claims for shortages, damages, or billing errors must be reported within 24 hours of product pickup or delivery. Claims made after 24 hours will be waived.
If a product is defective, the Customer must allow MJ Granite to inspect it. Until resolved, the Customer is responsible for keeping the product in good condition.
MJ Granite operates as an independent contractor. The Customer is not authorized to act as a representative or agent of MJ Granite
MJ Granite reserves the right to change its terms and conditions at any time without prior notice.
